Mygino Software provides this web site ("MyEvent.co.za") to you on the basis of the following terms and conditions ("Terms and Conditions"). By accessing any page on MyEvent.co.za, you agree to be bound by these Terms and Conditions. These Terms and Conditions may be updated by Mygino Software from time to time by posting the updated Terms and Conditions without prior separate notification to you. You should check the Terms and Conditions each time you access MyEvent.co.za to check for updates.
2. Disclaimer
Mygino Software hereby excludes all conditions, warranties, representations or other terms concerning the supply or purported supply of, failure to supply or delay in supplying any service in connection with MyEvent.co.za or that MyEvent.co.za is accurate, complete or up-to-date, which might but for this Section 2 have effect between Mygino Software and you, or would otherwise be implied into or incorporated into these Terms and Conditions or any collateral contract, whether by statute, common law or otherwise. You understand and agree that you are using MyEvent.co.za at your sole risk and that Mygino Software does not warrant that MyEvent.co.za will meet your requirements or that MyEvent.co.za will be uninterrupted, error free or secure. Any content or services provided via MyEvent.co.za or in connection with MyEvent.co.za by Mygino Software is done so on an "AS IS" and on an "AS AVAILABLE" basis and Mygino Software makes no representations or endorsement of any kind, whether expressed or implied, with respect to MyEvent.co.za for the content or services included in, or made available in connection with, MyEvent.co.za. Mygino Software reserves the right at its sole discretion, to amend or withdraw any content or services offered as part of MyEvent.co.za.
3. Liability
Mygino Software, any other party (whether or not involved in creating, producing, maintaining or delivering MyEvent.co.za), and any of Mygino Software's group companies and the officers, directors, employees, shareholders or agents of any of them, exclude all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party, (including without limitation, any direct, indirect, punitive or consequential loss or damages), or any loss or damages arising from or connected in any way to business interruption, and whether in tort (including without limitation negligence), contract or otherwise in connection with MyEvent.co.za in any way or in connection with the use, inability to use or the results of use of MyEvent.co.za, any web sites linked to MyEvent.co.za or the material on such web sites, including but not limited to loss or damage due to viruses that may infect your computer equipment, software, data or other property on account of your access to, use of, or browsing MyEvent.co.za or downloading of any material from MyEvent.co.za or any web sites linked to MyEvent.co.za. This shall not affect your statutory rights.
Nothing in these Terms and Conditions shall exclude or limit Mygino Software's liability for (i) death or personal injury caused by its negligence; (ii) fraud; or (iii) any liability which cannot be excluded or limited under applicable law.
4. Privacy Policy
If you choose to register on any part of MyEvent.co.za, you agree to provide Mygino Software with the accurate data as requested in the registration form. For details of our use and transfer of your personal data, please refer to this PRIVACY POLICY.
PRIVACY POLICY
1. The information provided in a form or otherwise via MyEvent.co.za will be used by Mygino Software for the purpose of providing the services that you have requested by way of MyEvent.co.za.
2. From time to time Mygino Software, Mygino Software affiliates or agents might use this information for marketing purposes or to inform you about other products and services, which we think might be of interest for you. You can specify whether you wish to receive such information in the appropriate box in your registration form.
3. We are committed to protecting your privacy. Your personal data is held on a secure computer and shall not be processed for any other purpose than those set out in this Privacy Policy. The server Mygino Software uses to store this information is accessible to authorised staff only, is further connected to the Internet through a firewall and is therefore not accessible to the public.
4. We will only hold your personal information for the duration necessary to allow us to provide the services that you have requested or for any additional period as required by law.
5. This Privacy Policy may be amended by Mygino Software from time to time.
5. Competition Notice
These Terms and Conditions together with any specific rules set out in Competition Notices (as defined below) are the Competition Rules ("Rules") and apply to competitions included on MyEvent.co.za ("Competition"), unless otherwise expressly stated. By entering a competition, entrants agree to be bound by these Rules.
COMPETITION NOTICE
1. The competition is organised by Mygino Software for MyEvent.co.za.
2. Mygino Software reserves the right to cancel or amend the Competition, the Competition Notice or these Rules at any time without prior notice. Any changes will be posted either within the Competition Notice or these Rules.
3. In the event of any dispute regarding the Rules, Competition Notice, conduct, results and all other matters relating to a Competition, the decision of Mygino Software shall be final and no corresponding or discussion shall be entered into.
Qualifying Entrants
4. To qualify to enter the Competition you must be resident in South Africa.
5. Employees of Mygino Software or any company involved in the Competition or any such person's subsidiary or associated companies, agents or members of their families or households, are not eligible to enter the Competition. Mygino Software reserves the right to verify the eligibility of all entrants.
6. Additional eligibility requirements may apply to a specific Competition.
7. By entering the Competition, you hereby warrant that all information submitted by you is true, current and complete.
8. Mygino Software assumes that by using MyEvent.co.za and entering the Competition (and you warrant that) either you have legal capacity to enter the Competition and agree to the Rules (i.e. that you are of sufficient age and mental capacity and are entitled to be legally bound in contract) or your parents have consented to your entry of the Competition and use of these Rules.
9. Mygino Software reserves the right to disqualify any entrant if it has reasonable grounds to believe the entrant has breached any of these Terms and Conditions.
10. In the event that any entrant is disqualified from the Competition, Mygino Software in its sole discretion may decide whether a replacement should be selected. In this event, any further entrant will be selected on the same criteria as the original entrant and will be subject to these Rules.
Competition Entries
11. Only one entry per person per Competition is allowed and multiple entries will result in an entrant being disqualified. Where a winner has been selected and Mygino Software discovers or has reasonable grounds to believe the winner has made more than one entry, Mygino Software reserves the right to select an alternative winner. Any further entrant will be selected on the same criteria as the original entrant and will be subjected to these Rules.
12. Competition entries must be made in the manner and by the closing date specified on the Competition Notice. Failure to do so will disqualify the entry.
13. There is no purchase requirement to enter a Competition and there is no charge to register for use of MyEvent.co.za.
Prizes
14. Prize winners will be chosen at random unless specified otherwise in the Competition Notice, from all qualifying entries within 28 days of the closing date specified in the Competition Notice. Tie-breakers will be judged by Mygino Software and, if required by law, by an independant adjudicator. In all matters, the decision of the judge(s) and Mygino Software shall be final and no correspondence or dicussion shall be entered into.
15. Prize winners will be notified in the manner and within the time specified on the Competition Notice. Return of any prize notification as undeliverable or failure to reply as specified in the notification within the time stated therein may result in disqualification and selection of an alternate winner. If more than one prize is awarded only one prize per entrant will be awarded. Competition winner(s)' names may be published on MyEvent.co.za or you can write to MyEvent.co.za, PO Box 223, Rondebosch, 7701 naming the the specific competition including a self-addressed stamped envelope for a list of winnders.
16. Claims for prizes must be made in the manner and within the time specified on the Competition Notice. Failure to claim a prize within this time or in the manner specified may result in disqualification and selection of an alternate winner.
17. Prizes are non-transferable. Mygino Software reserves the right to substitute prizes of equal or greater value at any time.
18. Prizes are awarded at Mygino Software's discretion and no prizes will be awarded as a result of improper actions by or on behalf of any entrant.
19. Where a prize may not be appropriate for a younger contestant, the minimum age for entry will be stated in the Competition Notice and must be observed. Mygino Software reserves the right to request written proof of age of any winner.
Intellectual Property Rights
20. Any information submitted by you must be personal to and relate specifically to you. You hereby warrant that the information which you submit and/or distribute will not infringe the intellectual property, privacy or any other rights of any third party, and will not contain anything which is libellous, defamatory, obscene, indecent, harassing or threatening. If relevant, Mygino Software reserves the right, but not the obligation, to screen, filter and/or monitor information provided by you and to edit, refuse or distribute or remove the same.
Liability
21. Mygino Software cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant entering the Competition or as a result of accepting any prize. Mygino Software is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including injury or damage to entrant's or any other person's computer or mobile telephone related to or resulting from participation or downloading any materials in the Competition. Nothing shall exclude Mygino Software's liability for death or personal injury as a result of its negligence.
6. Trademark
You must not display or use in any manner Mygino Software trademarks or logos without Mygino Software's prior written permission.
